Terms and Conditions for the Purchase and Use of Digital Gift Cards
1. Seller Information
These conditions govern the purchase and use of Digital Gift Cards (hereinafter referred to as “Gift Card”) issued by:

2. Subject Matter
These conditions govern the sale and use of Gift Cards available for purchase through the Website.
The purchase and use of the Gift Card imply full acceptance of these Terms and Conditions.
3. Nature of the Gift Card
The Gift Card is a prepaid digital voucher that allows the holder to purchase products and/or services available on the Website up to the indicated value.
The Gift Card:
· does not constitute electronic money;
· is not a financial instrument;
· does not generate interest.
4. Purchase Methods
Gift Cards may only be purchased through the Website.
The customer may select:
· one of the available amounts;
· a custom amount if permitted by the platform.
Payment may be made using the methods indicated on the Website (e.g., credit card, PayPal, or other electronic payment systems).
Following payment confirmation, the customer will receive a digital Gift Card containing a unique code usable on the Website at the e-mail address provided during purchase.
5. Gift Card Delivery
The Gift Card is delivered in digital format via e-mail to the address provided during the purchase process.
The customer must provide the e-mail address to which the Gift Card will be sent; it is the customer’s responsibility (and Fenice s.r.l. shall not be liable for any errors) to ensure that the e-mail address entered is correct, active, and able to receive e-mails.
Delivery generally occurs within a few minutes of payment confirmation, subject to technical issues or security checks.
6. Use of the Gift Card
The Gift Card may only be used on the Website.
To use the Gift Card, the relevant code must be entered in the designated field during the checkout process.
If:
· the order amount exceeds the Gift Card value, the difference must be paid using one of the available payment methods;
· the order amount is less than the Gift Card value, the remaining balance will remain available until the Gift Card expires. The customer may view the Gift Card balance in the Account section.
7. Validity and Expiry
The Gift Card is valid for 24 months from the date it is sent to the e-mail address indicated by the customer, unless otherwise specified.
Once the validity period has expired, the Gift Card can no longer be used or refunded.
It is the customer’s responsibility to check the expiry date; Fenice shall not be liable nor required to issue a refund in the event that the Gift Card still has available credit at the time of expiry.
8. Limitations
La Gift Card:
· cannot be converted into cash;
· is not rechargeable unless otherwise indicated;
· cannot be used to purchase other Gift Cards unless otherwise provided.
The Seller reserves the right to cancel or suspend a Gift Card in the event of fraudulent, unlawful, or use contrary to these Terms and Conditions.
9. Loss, Theft, or Unauthorized Use
The Gift Card may be used by anyone in possession of the relevant code.
The Seller is not liable for any unauthorized use arising from:
· loss or disclosure of the code;
· unauthorized access to the customer’s e-mail account;
· voluntary sharing of the code.
10. Right of Withdrawal
Pursuant to Articles 52 et seq. of the Italian Consumer Code, a customer who qualifies as a consumer has the right to withdraw from the contract within 14 days of purchase, without obligation to provide reasons.
The right of withdrawal shall lapse if the Gift Card has been used, even partially, before the expiry of the withdrawal period.
To exercise the right of withdrawal, the consumer must send, within 14 days from the date of issuance of the Gift Card, a written notice to:
In the event of a valid withdrawal, Fenice srl will refund the amount paid within 14 days using the same payment method used for the purchase.
11. Refunds for Orders Paid with Gift Card
In the event of a refund relating to an order paid with a Gift Card:
· the portion paid via Gift Card will be re-credited as Gift Card balance;
· any portion paid with other methods will be refunded using the same payment method.
The credit refunded to the Gift Card will be valid for 12 months from the date the refund is credited.
12. Personal Data Protection

Data provided during the purchase of the Gift Card will be processed exclusively for:
· order management;
· issuance and delivery of the Gift Card;
· customer support;
· legal and tax compliance.

13. Amendments to the Terms and Conditions
Fenice srl reserves the right to amend these Terms and Conditions at any time.
Amendments shall take effect from the date of publication on the website.
14. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For any dispute:
· if the buyer is a consumer, the competent court shall be the court of the consumer’s place of residence or domicile;
· in all other cases, the competent court shall be the Court of Milan.
